    Township Establishment application in Johannesburg.

Township establishment converts a farm portion or holding into a proclaimed township - a layout of individually registrable erven with streets, public open space and engineering services. It is the heaviest application in South African planning law, and the foundation on which greenfield estates and new residential or industrial precincts are built.

    What it is

    Understanding a township establishment

Unlike a subdivision, which divides a property into portions, township establishment creates an entirely new cadastral entity: a named township with a general plan, a street layout, erven zoned for their intended uses, and public places vesting in the municipality. The general plan is approved by the Surveyor-General and the township is then proclaimed, after which individual erven can be transferred.

The application is multidisciplinary by nature. Alongside the planning motivation, a municipality will ordinarily require engineering services reports covering water, sewer, stormwater and roads, a traffic impact assessment, geotechnical investigation, and confirmation of bulk services capacity - and separately, environmental authorisation where the National Environmental Management Act 107 of 1998 listed activities are triggered.

Approval comes with substantial conditions of establishment: services to be installed, contributions to be paid, land to be transferred to the municipality, and a period within which the township must be established. Meeting those conditions, rather than obtaining the approval, is usually the longest phase of the project.

The Spatial Planning and Land Use Management Act 16 of 2013 (SPLUMA) is the national framework: it requires every municipality to adopt its own land use scheme and municipal planning by-law, and it makes the municipality - not the province - the authority of first instance on land development applications. Township establishment is dealt with under the municipal planning by-law, with the general plan and proclamation governed by the Land Survey Act 8 of 1997 and the Deeds Registries Act 47 of 1937.

    Township establishment vs subdivision

A subdivision splits an existing erf into portions within an area that is already a township. Township establishment creates the township itself, including the public streets and open spaces, on land that has none. Where a large landholding is to be broken into many erven with new internal roads, subdivision is not the correct instrument - township establishment is.

Legal basisSPLUMA (Act 16 of 2013) and the municipal planning by-law, with the Land Survey Act 8 of 1997, the Deeds Registries Act 47 of 1937 and, where triggered, the National Environmental Management Act 107 of 1998.

    What's specific to Johannesburg

    • Johannesburg levies development contributions separately from the application fee, calculated on the additional impact a development generates rather than as a flat charge.
    • Notice of an application is published in the Provincial Gazette; that publication is charged on top of the lodgement fee.
    • The Municipal Planning Tribunal sits on a scheduled cycle - missing a cycle, rather than the assessment itself, is frequently what extends a Johannesburg timeline.

    FAQ

    Common questions

Do I need a registered town planner for a township establishment?

Most South African municipalities - including Johannesburg - require land use applications to be lodged by a SACPLAN-registered town planner. Landlodz works with registered and verified town planners, and every application is reviewed and submitted by a registered planner before it reaches the municipality.

How much does a township establishment application cost in Johannesburg?

The Landlodz preparation and lodgement fee starts from R 87 720. On top of that you pay the statutory City of Johannesburg - Development Planning application fee, which is set by that municipality's gazetted tariff schedule - we don't estimate it, our planner confirms the exact amount before lodgement.

Are the Johannesburg township establishment fees fixed?

Gauteng metros publish their own fee schedules and tend to charge premium rates for higher-density rezonings and township establishments. Landlodz shows the current published tariff for City of Johannesburg - Development Planning only where we hold a verified figure; otherwise our assigned planner confirms it directly with the municipality before lodgement.

Is VAT charged on the township establishment fee?

Landlodz is not VAT-registered, so no VAT is added to the preparation fee. Statutory municipal fees are charged directly by City of Johannesburg - Development Planning. Your itemised invoice shows every line before you pay.

    What about hidden costs?

Additional costs may include surveyor, conveyancer, traffic impact, or environmental specialist input depending on the proposal. Our planner flags these in the feasibility review before you commit.

How long does a township establishment take in Johannesburg?

Typical decision: 120-240 days from acceptance. The clock starts the day our planner accepts your application as complete.

What causes delays in Johannesburg township establishment applications?

Gauteng tribunals (MPT) sit on fixed cycles; missing a cycle can add 4-6 weeks to a decision. The most common avoidable delay is incomplete documentation that triggers a request for resubmission.

Can the Johannesburg township establishment timeline be sped up?

City of Johannesburg - Development Planning runs on statutory clocks - they can't be shortened. What you can control is pack quality: a complete, planner-prepared pack avoids the back-and-forth that usually costs 30-60 days.

When can I lodge building plans?

Building plans require an approved land-use right. Most owners start architectural work in parallel with the township establishment, but only lodge the building plan submission once City of Johannesburg - Development Planning has issued its decision letter and recorded the new right.
