What Is a Zoning Certificate in South Africa? The Complete 2026 Guide

A zoning certificate is the official municipal document that tells you exactly how a piece of land may be used. It is issued by the local municipality where the property is located, and it is the only legally authoritative record of a property's zoning, primary rights, consent uses and development parameters under that city's zoning scheme.

What Is a Zoning Certificate in South Africa? The Complete 2026 Guide

In South Africa zoning certificates are issued under the Spatial Planning and Land Use Management Act (SPLUMA, Act 16 of 2013) and the municipal planning by-laws of each city. Every SPLUMA-aligned municipality - from the City of Cape Town to the smallest rural local council - issues a version of this certificate.

If you are buying property, selling property, applying for a building plan, opening a guest house, building a granny flat, starting a home business or applying to the bank for finance, you will be asked for the zoning certificate at some point. This guide explains exactly what is on it, how to read it and how to obtain it.

    01

What information appears on a zoning certificate

A zoning certificate is a short formal document, usually one or two pages, signed by an authorised municipal official. Although the layout differs slightly between municipalities, every certificate covers the same nine pieces of information.

    Property description

Full erf number (or farm portion), township name, registration division and registered extent in square metres.

    Current zoning

The zoning category under the applicable town planning scheme - for example Single Residential 1, General Residential 2, General Business 1 or Industrial 2. This is the most important line on the certificate.

    Primary land use rights

The uses you may carry out as of right - typically a dwelling house on a residential erf, or shops and offices on a business erf - without any further application.

    Consent uses

Uses you may carry out only with the municipality's written consent (a consent use application). Examples include guest houses, places of instruction, home enterprises and second dwellings.

    Development parameters

Maximum coverage, floor factor / floor area ratio (FAR), height in storeys or metres, building lines (street and lateral), parking ratios and density.

    Conditions of title

Restrictive conditions registered against the title deed - for example servitudes, building line conditions or specific use restrictions imposed by a developer.

    Overlay zones

Heritage overlays, urban edge, environmental overlays, scenic drive overlays and any other layers that constrain development.

    Approved departures or consents

Any historical departures, consent uses or rezonings that have been granted on the property.

    Issue date and reference number

The date of issue is critical: most municipalities, banks and conveyancers will only accept a certificate that is less than three or six months old.

    02

Why you need a zoning certificate

There are five scenarios where a zoning certificate is non-negotiable.

First, property transactions. Conveyancers routinely request a zoning certificate before transfer to confirm that the property's use complies with title conditions and that the seller has not contravened the zoning scheme.

Second, building plans. Municipal building control will not approve a building plan submission without confirming current zoning. The certificate proves the proposed building falls within coverage, FAR, height and building lines.

Third, land use applications. Every rezoning, consent use, subdivision, departure and removal of restrictions application requires a recent zoning certificate as a baseline document.

Fourth, business licensing. Health certificates, liquor licences, school licences and even Airbnb operations are often refused if zoning does not permit the use.

Fifth, finance. Most banks and development finance institutions require a zoning certificate before approving a bond, especially for non-standard properties such as smallholdings, guest houses or mixed-use buildings.

    03

How to get a zoning certificate in South Africa

You apply to the municipality where the property is located. Every municipality issues its own certificates - you cannot get a zoning certificate for a Cape Town erf from the City of Johannesburg.

The application is normally straightforward: complete a request form, provide the erf number and a copy of the title deed (or surveyor general diagram), pay the prescribed fee and wait. Some metros now offer online ordering; smaller municipalities still require a counter visit or email request.

Turnaround times range from same-day in the City of Cape Town (often issued from a counter while you wait) to 30 working days in under-resourced rural councils. The four major metros usually issue within 5-10 working days.

    04

How much does a zoning certificate cost

Municipal zoning certificate fees are gazetted annually as part of each council's tariff schedule. For the 2025/26 financial year, fees range from roughly R150 in smaller councils to R650 in the major metros. The City of Cape Town charges R485, City of Johannesburg roughly R570 and City of Tshwane around R400 (always confirm against the current tariff schedule).

If you ask a town planner to obtain the certificate for you, planner fees typically add R500-R1,500 to the municipal cost depending on how quickly you need it and whether interpretation of the result is included.

    05

How to read your zoning certificate

Start with the zoning category and look it up in the relevant town planning scheme. The scheme tells you the primary rights, consent uses and development parameters that apply to that category.

Cross-check the development parameters against your existing or planned building. If your coverage exceeds the permitted maximum, or your building line is encroached, you may need a departure application before you can build or sell.

Look closely at the conditions of title and overlay zones. These are often missed and frequently cause problems at building plan stage.

    06

Common mistakes when reading a zoning certificate

The single most common mistake is confusing the property's zoning with the property's land use. A property zoned Single Residential 1 may, for example, be used as a guest house under a previously approved consent - but the zoning is still Single Residential 1, not Business. Always read the consent uses and approved consents fields together.

Another frequent error is relying on an outdated certificate. Zoning schemes change. A property that was zoned General Residential 2 in 2018 may now sit under a new restructured zoning category following a wall-to-wall rezoning by the municipality.

Finally, do not rely on the zoning certificate alone for development potential. The site itself - slope, services, heritage, environmental constraints - often limits what the zoning theoretically allows.

    07

Zoning certificate vs zoning information report vs zoning compliance letter

South African councils use three overlapping documents and the names are not interchangeable. Confusing them is the single biggest reason transactions stall.

A zoning certificate is the formal, signed statement of the zoning category, primary rights and development parameters. It is the only one banks, conveyancers and the deeds office treat as authoritative.

A zoning information report (sometimes called a zoning extract or pre-application report) is a longer, advisory document that interprets the certificate against a proposed development. It is useful for feasibility but not legally binding.

A zoning compliance letter is issued where the municipality confirms that an existing or proposed use complies with the current zoning. Banks routinely ask for this on non-standard properties (guest houses, mixed-use, smallholdings).

If a conveyancer, bank or municipality asks for a 'zoning letter', clarify which of the three they need - ordering the wrong one wastes 10-30 working days.

    08

Zoning certificate cost and turnaround - DIY vs Landlodz

Doing it yourself in a metro normally means: pull the title deed (R75-R150), complete the council form, pay the gazetted tariff (R150-R650), email or upload to the portal, and follow up. Expect 5-10 working days at the four metros and 15-30 days at smaller councils.

Doing it through Landlodz means: book a free planner consult, share the address or erf number, and a SACPLAN-registered planner lodges the request, follows up with the council, interprets the certificate against your intended use and emails you the document. A published from-price for the Landlodz work, with the council tariff paid by you directly to the municipality, and no follow-up calls.

Cost comparison: DIY ~R150-R650 municipal fee (third-party, paid to the council) plus your time, versus the Landlodz fee published on the Landlodz pricing page, which includes interpretation. The Landlodz route is the right choice when you need certainty before a transaction or building plan deadline, or when the property sits in a council with slow turnaround.

    09

When the certificate raises a red flag

Five patterns regularly appear on certificates that, left unaddressed, kill transactions or building plans:

    1. The current use does not match the zoning - for example a guest house operating on a Single Residential 1 erf without a consent use approval. Remedy: a consent use application or rezoning.

    2. Coverage or FAR already exceeds the maximum - common on older properties extended without approval. Remedy: a departure application or removal of restrictions.

    3. Title conditions restrict the intended use - for example a 'dwelling only' restriction registered by the original developer. Remedy: removal of restrictive conditions.

    4. Building lines have been encroached - fences, garages or extensions across a 3m street building line. Remedy: a building line departure.

    5. The property falls within an overlay zone (heritage, urban edge, environmental) that imposes additional constraints not visible on the zoning category. Remedy: confirm with the relevant heritage / environmental authority before proceeding.

A Landlodz planner reviews every certificate against your intended use and flags these issues before they become legal problems.

    Frequently asked questions

How long is a zoning certificate valid?+

Most municipalities issue zoning certificates without an explicit expiry date, but conveyancers, banks and building control typically only accept certificates issued within the last three to six months. If yours is older, request a fresh one.

Can I get a zoning certificate online in South Africa?+

Cape Town, Johannesburg, Tshwane and eThekwini all offer online zoning certificate ordering through their planning portals (eDAMS, JoziPlan, etc.). Smaller councils generally still require a counter visit, email or fax request.

What does it mean if my zoning is 'Single Residential 1'?+

Single Residential 1 typically allows one dwelling house per erf, with a second dwelling or home enterprise possible by consent. Coverage caps and FAR vary by municipality - usually around 50% coverage and FAR 0.6-0.8.

Can the zoning of my property change without me knowing?+

Yes. Municipalities run periodic town-planning scheme reviews and wall-to-wall rezonings. Public notice is given but is easy to miss. Always pull a fresh certificate before any major decision.

What is the difference between zoning and land use?+

Zoning is the legal category applied to land under the zoning scheme. Land use is what is actually happening on the land. The two can differ where consent uses or approved departures exist.

Do I need a zoning certificate to sell my house?+

Not always, but conveyancers usually request one to confirm the use complies with title conditions and to avoid post-transfer disputes.

What happens if my property's use does not match its zoning?+

You are operating in contravention of the zoning scheme, which is an offence under SPLUMA and the municipal planning by-law. Penalties include fines and orders to cease. The remedy is to apply for rezoning, consent use, departure or removal of restrictions, depending on the situation.

Can Landlodz get a zoning certificate for me?+

Yes. Book a free planner consult and we will obtain, interpret and lodge your zoning certificate request with the responsible municipality nationwide.

What is the difference between a zoning certificate and a zoning compliance letter?+

The zoning certificate states the property's zoning category and rights. A zoning compliance letter goes further and confirms whether a specific existing or proposed use complies with that zoning. Banks usually ask for the compliance letter on guest houses, mixed-use and smallholding properties.

Is a zoning certificate the same as a title deed?+

No. The title deed records ownership and registered conditions. The zoning certificate records the municipal land use category and development parameters. You need both for any property transaction or development application.

Can a zoning certificate be wrong?+

Yes. Older certificates sometimes pre-date wall-to-wall rezonings, and clerical errors do occur. If anything on the certificate contradicts the current scheme map or your records, request a corrected certificate before relying on it.

Does Landlodz charge separately for the municipal fee?+

The Landlodz fee published on the pricing page covers our work. The council tariff is a statutory charge paid by you directly to the municipality.
