Removal of Restrictions application in Johannesburg.

A removal of restrictions application removes, suspends or amends a condition registered against the title deed of a property. Title conditions are a separate legal layer from the municipal zoning scheme - a property can be correctly zoned for exactly what you intend and still be blocked by a restrictive condition imposed decades ago.

How removing a title deed restriction runs under Johannesburg's planning by-law

In Johannesburg, an application to amend, suspend or remove a restrictive condition in a title deed is made under section 41 of the City of Johannesburg Municipal Planning By-law, 2024. Section 41 covers restrictions, obligations, servitudes and reservations that deal with subdivision, the use of the land or building requirements.

Where the application is only about such a condition, the by-law applies the same notice procedure as a rezoning. The steps below come from the by-law, with the section number for each.

    Who applies

The owner of the land. The City may also act on its own initiative.

    s 41(4)-(5)

    Procedure

The rezoning notice procedure in section 21(2) to (7) applies, with the necessary changes.

    s 41(7)

    Public notice

Published once, at the same time, in the Provincial Gazette and a newspaper, with a notice on the property and letters to adjoining owners and occupiers.

    s 41(7) read with s 21(2)

    Objections

28 days from the date of publication.

    s 41(7) read with s 21(2)(e)

    Decision if nobody objects

Decided by the authorised official within 60 days after the administrative phase ends.

    s 41(9)

    Decision if there are objections

Referred to the Municipal Planning Tribunal, as for a rezoning.

    s 41(7) read with s 21(6)

    Conditions that are excluded

Some conditions cannot be dealt with this way, including mining-related conditions and building lines imposed under roads legislation unless the roads authority consents in writing.

    s 41(3)

    Watch out for

    • A title condition and the zoning are two separate controls. Removing the condition does not change the zoning, and a rezoning does not remove the condition.
    • If the property is bonded, expect the bondholder to be involved before the title deed can be changed.
    • Check the whole title deed first. Conditions are often repeated or cross-referenced, and missing one means a second application.

    What it is

    Understanding a removal of restrictions

Restrictive conditions typically originate from the original township establishment or from an earlier subdivision, and they were registered against the title to bind successive owners. Common examples are 'one dwelling house only', 'no business or trade shall be conducted', 'no further subdivision', and building line or height restrictions that are stricter than the current scheme.

Because these conditions live in the deed rather than the scheme, a rezoning does not touch them. Where both stand in the way - for example an old 'dwelling house only' condition on an erf you also need rezoned to Business - both applications are required, and they are usually lodged together so the municipality considers one coherent proposal.

The application must identify each condition precisely as it appears in the deed, explain why it has become obsolete or unreasonable in current circumstances, and address anyone who benefits from the condition. Some conditions are enforceable by neighbours or by a former township owner rather than by the municipality, which changes who must be notified and consulted.

The Spatial Planning and Land Use Management Act 16 of 2013 (SPLUMA) is the national framework: it requires every municipality to adopt its own land use scheme and municipal planning by-law, and it makes the municipality - not the province - the authority of first instance on land development applications. Since SPLUMA came into force, removal of restrictive conditions is dealt with as a municipal planning application by the municipality itself, rather than by the provincial administration under the older removal-of-restrictions legislation. Once approved, the amendment must be endorsed against the title at the Deeds Office by a conveyancer before it takes effect.

    Removal of restrictions vs departure

A departure relaxes a rule in the municipal land use scheme. A removal of restrictions removes a condition in the title deed. They can look identical from the outside - both might be about a building line - but they are governed by different instruments, notified to different parties, and one cannot substitute for the other. Your planner establishes which instrument actually imposes the restriction before lodging anything.

Legal basisThe municipal planning by-law adopted under SPLUMA (Act 16 of 2013), with Deeds Office endorsement under the Deeds Registries Act 47 of 1937.

    What's specific to Johannesburg

    • Johannesburg levies development contributions separately from the application fee, calculated on the additional impact a development generates rather than as a flat charge.
    • Notice of an application is published in the Provincial Gazette; that publication is charged on top of the lodgement fee.
    • The Municipal Planning Tribunal sits on a scheduled cycle - missing a cycle, rather than the assessment itself, is frequently what extends a Johannesburg timeline.

    Why Johannesburg is different

    FAQ

    Common questions

Which law governs the removal of title deed restrictions in Johannesburg?

Section 41 of the City of Johannesburg Municipal Planning By-law, 2024. It covers the amendment, suspension or removal of restrictive conditions, obligations, servitudes and reservations in respect of land.

Is a removal of restrictions application advertised in Johannesburg?

Yes. Section 41(7) applies the rezoning notice procedure, so notice is published in the Provincial Gazette and a newspaper, displayed on the property and sent to adjoining owners and occupiers, and objections may be lodged within 28 days of publication.

Does removing a title deed restriction change my zoning in Johannesburg?

No. The title deed and the land use scheme are separate controls and both must allow what you plan to do. If the zoning also stands in the way, a rezoning or consent use application is needed as well.

Do I need a registered town planner for a removal of restrictions?

Most South African municipalities - including Johannesburg - require land use applications to be lodged by a SACPLAN-registered town planner. Landlodz works with registered and verified town planners, and every application is reviewed and submitted by a registered planner before it reaches the municipality.

How much does a removal of restrictions application cost in Johannesburg?

The Landlodz preparation and lodgement fee starts from R 25 800. On top of that you pay the statutory City of Johannesburg - Development Planning application fee, which is set by that municipality's gazetted tariff schedule - we don't estimate it, our planner confirms the exact amount before lodgement.

Are the Johannesburg removal of restrictions fees fixed?

Gauteng metros publish their own fee schedules and tend to charge premium rates for higher-density rezonings and township establishments. Landlodz shows the current published tariff for City of Johannesburg - Development Planning only where we hold a verified figure; otherwise our assigned planner confirms it directly with the municipality before lodgement.

Is VAT charged on the removal of restrictions fee?

Landlodz is not VAT-registered, so no VAT is added to the preparation fee. Statutory municipal fees are charged directly by City of Johannesburg - Development Planning. Your itemised invoice shows every line before you pay.

    What about hidden costs?

Additional costs may include surveyor, conveyancer, traffic impact, or environmental specialist input depending on the proposal. Our planner flags these in the feasibility review before you commit.

How long does a removal of restrictions take in Johannesburg?

Typical decision: 120-240 days from acceptance. The clock starts the day our planner accepts your application as complete.

What causes delays in Johannesburg removal of restrictions applications?

Gauteng tribunals (MPT) sit on fixed cycles; missing a cycle can add 4-6 weeks to a decision. The most common avoidable delay is incomplete documentation that triggers a request for resubmission.
