Removal of Restrictions application in Durban.

A removal of restrictions application removes, suspends or amends a condition registered against the title deed of a property. Title conditions are a separate legal layer from the municipal zoning scheme - a property can be correctly zoned for exactly what you intend and still be blocked by a restrictive condition imposed decades ago.

How removing a title deed restriction runs under eThekwini's planning by-law

In Durban, the removal, amendment or suspension of a restrictive title condition is dealt with under section 49 of the eThekwini Municipality Planning and Land Use Management By-law, 2016. It is a Category 3 application, decided by the Head.

The steps below come from the by-law, with the section number for each.

    Category

A Category 3 application, decided by the Head.

    s 28(1)-(2)

The application must include a certificate from a conveyancer confirming that the title deed has been examined and that no other title conditions are affected.

    s 49(5)

    Public notice

Required: once in two local newspapers, an A3 notice on every road frontage and notice served on adjoining and affected owners, organs of state and the ward councillor.

    s 32(1), s 34

    Objections

    Written objections within 30 days.

    s 34(1)(f), s 36(1)

    Conditions that are excluded

The by-law does not allow this route for certain conditions, including those protecting registered mining rights, certain roads-related conditions and conditions about the sale or inheritance of land.

    s 49(1)

    After the decision

The original title deed, the decision notice and the compliance certificate go to the Registrar of Deeds and the Surveyor-General.

    s 49(6)

    Appeals

A person whose rights are affected may appeal within 21 days of being notified of the decision.

    s 60(1)

    Watch out for

    • The conveyancer's certificate is needed at the start, not at registration, so line up a conveyancer before the application is lodged.
    • eThekwini's tariff charges more where the removal amounts to a material change.
    • Removing the condition does not change the zoning. Both the title deed and the regional scheme must allow the use.

    What it is

    Understanding a removal of restrictions

Restrictive conditions typically originate from the original township establishment or from an earlier subdivision, and they were registered against the title to bind successive owners. Common examples are 'one dwelling house only', 'no business or trade shall be conducted', 'no further subdivision', and building line or height restrictions that are stricter than the current scheme.

Because these conditions live in the deed rather than the scheme, a rezoning does not touch them. Where both stand in the way - for example an old 'dwelling house only' condition on an erf you also need rezoned to Business - both applications are required, and they are usually lodged together so the municipality considers one coherent proposal.

The application must identify each condition precisely as it appears in the deed, explain why it has become obsolete or unreasonable in current circumstances, and address anyone who benefits from the condition. Some conditions are enforceable by neighbours or by a former township owner rather than by the municipality, which changes who must be notified and consulted.

The Spatial Planning and Land Use Management Act 16 of 2013 (SPLUMA) is the national framework: it requires every municipality to adopt its own land use scheme and municipal planning by-law, and it makes the municipality - not the province - the authority of first instance on land development applications. Since SPLUMA came into force, removal of restrictive conditions is dealt with as a municipal planning application by the municipality itself, rather than by the provincial administration under the older removal-of-restrictions legislation. Once approved, the amendment must be endorsed against the title at the Deeds Office by a conveyancer before it takes effect.

    Removal of restrictions vs departure

A departure relaxes a rule in the municipal land use scheme. A removal of restrictions removes a condition in the title deed. They can look identical from the outside - both might be about a building line - but they are governed by different instruments, notified to different parties, and one cannot substitute for the other. Your planner establishes which instrument actually imposes the restriction before lodging anything.

Legal basisThe municipal planning by-law adopted under SPLUMA (Act 16 of 2013), with Deeds Office endorsement under the Deeds Registries Act 47 of 1937.

    Local detail

    What's specific to Durban

    • eThekwini requires the application to be signed off by a Professional Planner (Pr Pln) registered with SACPLAN. This is not universal across South African municipalities, and it is a real reason an eThekwini application is structured - and priced - differently from the equivalent Johannesburg submission.
    • eThekwini does not operate a single city-wide scheme: five regional land use schemes (Central, Inner-West, North, Outer-West and South) apply, so the development parameters depend on which region the property falls in.
    • eThekwini's tariff table prices short-term and student accommodation consent as its own named line, which few South African municipalities do - a signal the municipality treats short-stay guest accommodation as a land use question requiring consent.
    • Subdivision is charged as a basic fee plus a per-portion fee that tapers as the number of portions rises, so the cost per portion falls on larger subdivisions.

    FAQ

    Common questions

What do I need to apply to remove a title deed restriction in Durban?

Along with the standard application documents, section 49(5) of the eThekwini Planning and Land Use Management By-law, 2016 requires a conveyancer's certificate confirming the title deed has been examined and that no other title conditions are affected.

Is a removal of restrictions application advertised in eThekwini?

Yes. Section 32(1) requires public notice for the removal, amendment or suspension of restrictive conditions. Notice is published once in two local newspapers, displayed on site and served on neighbours, and objections may be lodged within 30 days.

Can every title deed condition be removed in eThekwini?

No. Section 49(1) excludes certain conditions from this route, including those protecting registered mining rights, certain roads-related conditions and conditions about the sale or inheritance of land.

Do I need a registered town planner for a removal of restrictions?

Most South African municipalities - including Durban - require land use applications to be lodged by a SACPLAN-registered town planner. Landlodz works with registered and verified town planners, and every application is reviewed and submitted by a registered planner before it reaches the municipality.

How much does a removal of restrictions application cost in Durban?

The Landlodz preparation and lodgement fee starts from R 25 800. The statutory eThekwini Municipality - Development Planning application fee is R3,111 (R4,351 where the removal constitutes a material change) for the 2026/27 financial year (tariffs approved May–July 2026), per eThekwini, Tariff Tables 2026/2027 (dag.durban.gov.za), and is charged directly by the municipality.

Are the Durban removal of restrictions fees fixed?

KwaZulu-Natal fees follow each council's tariff schedule under the KZN Planning and Development Act and SPLUMA. Landlodz shows the current published tariff for eThekwini Municipality - Development Planning only where we hold a verified figure; otherwise our assigned planner confirms it directly with the municipality before lodgement.

Is VAT charged on the removal of restrictions fee?

Landlodz is not VAT-registered, so no VAT is added to the preparation fee. Statutory municipal fees are charged directly by eThekwini Municipality - Development Planning. Your itemised invoice shows every line before you pay.

    What about hidden costs?

Additional costs may include surveyor, conveyancer, traffic impact, or environmental specialist input depending on the proposal. Our planner flags these in the feasibility review before you commit.

How long does a removal of restrictions take in Durban?

Typical decision: 120-270 days from acceptance. The clock starts the day our planner accepts your application as complete.

What causes delays in Durban removal of restrictions applications?

eThekwini and the larger KZN locals stage public participation in 30-day windows; rural districts often run longer. The most common avoidable delay is incomplete documentation that triggers a request for resubmission.
