Departure / Relaxation application in Johannesburg.
A departure is relief from one specific development rule in the land use scheme - a building line, coverage, floor area ratio, height or parking requirement - without changing the zoning or the use. It is the narrowest of the land use applications: everything about the property stays as it is except the single parameter you cannot meet.
City of Johannesburg - Development Planning · Departure from provisions of the Land Use Scheme

What it is
Understanding a departure / relaxation
Schemes distinguish between permanent departures, which permanently relax a parameter for the property, and temporary departures, which allow a use or deviation for a fixed period. Most owner applications are permanent departures, and most of those are building line relaxations - a garage, carport, patio or extension that would otherwise sit closer to a boundary than the scheme permits.
The decision turns almost entirely on impact on neighbours and on the streetscape: overshadowing, loss of privacy, drainage, and whether the relaxation is consistent with what already exists in the area. Because the affected interests are usually confined to the immediate neighbours, notice is normally limited to them rather than published widely, which is part of why a departure is faster than a rezoning.
A departure cannot be used to authorise a use the zone does not allow, however small the departure looks on paper. Where a proposal needs both - a use that requires consent and a building that breaches a building line - both applications are required and are usually lodged together.
The Spatial Planning and Land Use Management Act 16 of 2013 (SPLUMA) is the national framework: it requires every municipality to adopt its own land use scheme and municipal planning by-law, and it makes the municipality - not the province - the authority of first instance on land development applications. The departure provisions themselves sit in the municipality's own planning by-law and land use scheme, so the categories and thresholds differ from one municipality to the next.
Departure vs removal of restrictions
A departure relaxes a rule in the municipal scheme; a removal of restrictions removes a condition in the title deed. A building line can be imposed by either, or by both at once, and relief from one has no effect on the other. Establishing which instrument actually imposes the restriction - the scheme or the deed - is the first step, because lodging the wrong application achieves nothing.
Legal basisThe departure provisions of the land use scheme, under the municipal planning by-law adopted in terms of SPLUMA (Act 16 of 2013).

Local detail
What's specific to Johannesburg
- Johannesburg levies development contributions separately from the application fee, calculated on the additional impact a development generates rather than as a flat charge.
- Notice of an application is published in the Provincial Gazette; that publication is charged on top of the lodgement fee.
- The Municipal Planning Tribunal sits on a scheduled cycle - missing a cycle, rather than the assessment itself, is frequently what extends a Johannesburg timeline.

FAQ
Common questions
Do I need a registered town planner for a departure / relaxation?
Most South African municipalities - including Johannesburg - require land use applications to be lodged by a SACPLAN-registered town planner. Landlodz works with registered and verified town planners, and every application is reviewed and submitted by a registered planner before it reaches the municipality.
How much does a departure / relaxation application cost in Johannesburg?
The Landlodz preparation and lodgement fee starts from R 15 480. The statutory City of Johannesburg - Development Planning application fee is R738 for the 2026/27 financial year (tariffs approved May–July 2026), per City of Johannesburg, Development Planning Fees Schedule 2026/2027 (joburg.org.za), and is charged directly by the municipality.
Are the Johannesburg departure / relaxation fees fixed?
Gauteng metros publish their own fee schedules and tend to charge premium rates for higher-density rezonings and township establishments. Landlodz shows the current published tariff for City of Johannesburg - Development Planning only where we hold a verified figure; otherwise our assigned planner confirms it directly with the municipality before lodgement.
Is VAT charged on the departure / relaxation fee?
Landlodz is not VAT-registered, so no VAT is added to the preparation fee. Statutory municipal fees are charged directly by City of Johannesburg - Development Planning. Your itemised invoice shows every line before you pay.
What about hidden costs?
Additional costs may include surveyor, conveyancer, traffic impact, or environmental specialist input depending on the proposal. Our planner flags these in the feasibility review before you commit.
How long does a departure / relaxation take in Johannesburg?
Typical decision: 120-240 days from acceptance. The clock starts the day our planner accepts your application as complete.
What causes delays in Johannesburg departure / relaxation applications?
Gauteng tribunals (MPT) sit on fixed cycles; missing a cycle can add 4-6 weeks to a decision. The most common avoidable delay is incomplete documentation that triggers a request for resubmission.
Can the Johannesburg departure / relaxation timeline be sped up?
City of Johannesburg - Development Planning runs on statutory clocks - they can't be shortened. What you can control is pack quality: a complete, planner-prepared pack avoids the back-and-forth that usually costs 30-60 days.
When can I lodge building plans?
Building plans require an approved land-use right. Most owners start architectural work in parallel with the departure / relaxation, but only lodge the building plan submission once City of Johannesburg - Development Planning has issued its decision letter and recorded the new right.
