Step 1 - Town planning consent
A spaza shop on a residentially zoned erf is a consent use in almost every municipality. You apply for a 'spaza shop', 'tuck shop' or 'home enterprise (retail)' consent use, depending on the wording in your zoning scheme.
Step 2 - Spaza shop registration
Under the 2024 Spaza Shop Registration Programme, every spaza shop must register with the local municipality. Owners must be South African citizens or permanent residents (the December 2024 regulations restricted foreign-national operation in some categories).
Step 3 - Business licence and health certificate
Section 2 of the Business Act 71 of 1991 requires a trading licence for selling foodstuffs. The municipal health department issues a certificate of acceptability for food premises.
Step 4 - Building compliance
The portion of the dwelling used as the shop must meet basic safety and accessibility requirements - the municipal building control office signs off.
Typical conditions on a spaza consent
Maximum trading floor area 25-40m², no external signage beyond a name board, limited trading hours (often 06:00-22:00), no liquor sales unless additional consent is obtained, and parking provision if more than two staff.
