    Rezoning application in Durban.

Rezoning is a formal, permanent change to the land use rights registered against a property - for example from Single Residential to General Business or General Residential. It amends the municipality's land use scheme itself in respect of that erf, which is why it is decided only after public notice and, in most cases, only on the strength of a motivation report prepared by a SACPLAN-registered planner.

    In Durban

How a rezoning runs under eThekwini's planning by-law

Rezoning in Durban is governed by the eThekwini Municipality Planning and Land Use Management By-law, 2016. The by-law sorts every application into a category, and the category decides who makes the decision.

The steps below come from the by-law, with the section number for each.

    Planning enquiry

The Municipality may hold an initial consultation to explain what the application needs. Where an enquiry is required and has not taken place, the Municipality must refuse to accept the application.

    s 22(1), s 24A(1)(a)

    Who decides

A rezoning that is in line with the Municipal Spatial Development Framework is a Category 3 application, decided by the Head. If an objection is lodged, or the proposal departs from the framework, it is decided by the Municipal Planning Tribunal.

    s 27(1), s 28(1)-(2)

    Starting public notice

Notice must begin within 14 days of the Municipality confirming that the application is complete.

    s 33(2)

    Newspaper notice

Published once in two local newspapers that circulate in the area.

    s 34(2)(a)

    Site notice and served notice

An A3 notice on every road frontage, kept legible for the whole notice period, plus notice served on adjoining and affected owners, organs of state and the ward councillor.

    s 34(4)-(6)

    Objections

Written objections must reach the Municipality within 30 days.

    s 34(1)(f), s 36(1)

    Applicant's reply

The applicant has 21 days from receiving the objections to respond.

    s 36(2)

    Appeals

A person whose rights are affected may appeal within 21 days of being notified of the decision.

    s 60(1)

    Conditions

If an approval is conditional and no period is set, the conditions must be met within two years or the approval lapses. With extensions the period cannot exceed five years.

    s 47(2)

    Watch out for

    • Whether the proposal fits the Spatial Development Framework decides the route. A proposal that departs from it goes to the Tribunal even before anyone objects.
    • The applicant carries the cost of all public notice, including both newspaper notices (section 34(7)).
    • A decision is suspended while an appeal is pending, so the 21-day appeal period matters even after an approval.

    What it is

    Understanding a rezoning

Every erf in South Africa sits in a zone defined by the municipality's land use scheme. The zone determines what the property may be used for and the parameters it must be developed within - coverage, floor area ratio, height, building lines and parking. A rezoning application asks the municipality to move the property from one zone to another, which changes both the permitted use and the parameter set that comes with it.

You need a rezoning when the use you intend is not permitted in the current zone at all, and is not available as a consent use either. Converting a house to offices or a retail premises, taking a single-residential erf to a higher-density residential zone, or bringing an existing non-conforming use onto a lawful footing are all rezoning cases.

Because a rezoning amends the scheme, it is permanent and it runs with the land rather than with the owner: it survives a sale, and it does not lapse if the use stops. That permanence is exactly why municipalities require public notice, consider objections, and refer contested matters to a Municipal Planning Tribunal rather than deciding them administratively.

The Spatial Planning and Land Use Management Act 16 of 2013 (SPLUMA) is the national framework: it requires every municipality to adopt its own land use scheme and municipal planning by-law, and it makes the municipality - not the province - the authority of first instance on land development applications. A rezoning is lodged under the relevant municipal planning by-law's scheme-amendment provisions, and the motivation must show the change is consistent with the municipality's spatial development framework and with SPLUMA's development principles - spatial justice, spatial sustainability, efficiency, spatial resilience and good administration (section 7).

    Rezoning vs consent use

A consent use permits one specified additional activity inside the existing zone, at the municipality's discretion, and the right typically lapses if the use ceases or if a condition attached to it is breached. A rezoning changes the zone itself, permanently, for every use that zone allows. If you only need one additional activity, a consent use is usually the narrower, faster and cheaper route; if you need the property's underlying development rights to change, only a rezoning achieves that.

Legal basisSPLUMA (Act 16 of 2013) read with the municipality's own planning by-law and land use scheme.

    What's specific to Durban

    • eThekwini requires the application to be signed off by a Professional Planner (Pr Pln) registered with SACPLAN. This is not universal across South African municipalities, and it is a real reason an eThekwini application is structured - and priced - differently from the equivalent Johannesburg submission.
    • eThekwini does not operate a single city-wide scheme: five regional land use schemes (Central, Inner-West, North, Outer-West and South) apply, so the development parameters depend on which region the property falls in.
    • eThekwini's tariff table prices short-term and student accommodation consent as its own named line, which few South African municipalities do - a signal the municipality treats short-stay guest accommodation as a land use question requiring consent.
    • Subdivision is charged as a basic fee plus a per-portion fee that tapers as the number of portions rises, so the cost per portion falls on larger subdivisions.

    FAQ

    Common questions

How long is the objection period for a rezoning in Durban?

30 days. Under sections 34(1)(f) and 36(1) of the eThekwini Planning and Land Use Management By-law, 2016, written objections must be lodged with the Municipality within 30 days of the notice.

Who decides a rezoning application in eThekwini?

A rezoning in line with the Municipal Spatial Development Framework is a Category 3 application decided by the Head (section 28). Where an objection is lodged, or the proposal departs from the framework, the Municipal Planning Tribunal decides it (sections 27 and 28(1)).

Can a rezoning decision in Durban be appealed?

Yes. Section 60(1) of the by-law allows a person whose rights are affected to appeal within 21 days of notification of the decision. The decision is suspended until the appeal is finalised.

Do I need a registered town planner for a rezoning?

Most South African municipalities - including Durban - require land use applications to be lodged by a SACPLAN-registered town planner. Landlodz works with registered and verified town planners, and every application is reviewed and submitted by a registered planner before it reaches the municipality.

How much does a rezoning application cost in Durban?

The Landlodz preparation and lodgement fee starts from R 36 120. The statutory eThekwini Municipality - Development Planning application fee is R3,465 (up to 5,000 m². R12,318 for 5,000 m²–5 ha; R30,756 for 5–10 ha; R30,756 plus R3,465 per additional hectare above 10 ha) for the 2026/27 financial year (tariffs approved May–July 2026), per eThekwini, Tariff Tables 2026/2027 (dag.durban.gov.za), and is charged directly by the municipality.

Are the Durban rezoning fees fixed?

KwaZulu-Natal fees follow each council's tariff schedule under the KZN Planning and Development Act and SPLUMA. Landlodz shows the current published tariff for eThekwini Municipality - Development Planning only where we hold a verified figure; otherwise our assigned planner confirms it directly with the municipality before lodgement.

Is VAT charged on the rezoning fee?

Landlodz is not VAT-registered, so no VAT is added to the preparation fee. Statutory municipal fees are charged directly by eThekwini Municipality - Development Planning. Your itemised invoice shows every line before you pay.

    What about hidden costs?

Additional costs may include surveyor, conveyancer, traffic impact, or environmental specialist input depending on the proposal. Our planner flags these in the feasibility review before you commit.

How long does a rezoning take in Durban?

Typical decision: 120-270 days from acceptance. The clock starts the day our planner accepts your application as complete.

What causes delays in Durban rezoning applications?

eThekwini and the larger KZN locals stage public participation in 30-day windows; rural districts often run longer. The most common avoidable delay is incomplete documentation that triggers a request for resubmission.
